General Terms and Conditions of Sale (GTC)

Important note: The French version of these terms and conditions shall prevail in the event of any discrepancy or difficulty of interpretation with a version in another language.

1. Scope of application and Validity

1.1 These General Terms and Conditions (hereinafter "GTC") govern all contractual relations, rights, and obligations between Gecodart SA (operator of the online shop www.gecodart.ch) and any natural or legal person (hereinafter referred to as "CUSTOMER") placing an order for products or services on the site.
1.2 The GTC form an integral part of the contract concluded between GECODART and the CUSTOMER. By validating their order, the CUSTOMER acknowledges having read these GTC and accepts them without reservation.
1.3 Any contrary condition laid down by the CUSTOMER shall be unenforceable against GECODART in the absence of express written acceptance by the latter.
1.4 GECODART reserves the right to modify these GTC at any time. The applicable conditions are those in force on the site at the date the order is placed.

 

2. Offer, Products and Conclusion of Contract

2.1 Geographical availability:

  • Rental: The products presented for these services are intended exclusively for CUSTOMERS domiciled in Switzerland and Liechtenstein.
  • Direct Sale and Made-to-Measure: These products are accessible to CUSTOMERS domiciled in Switzerland, Liechtenstein, and the European Economic Area (EEA).

Logistical note: Customers in the EEA may be supplied directly by our commercial partners located in Europe in order to optimize delivery times.

2.2 Characteristics: Products are presented with the greatest possible accuracy. However, minimal variations (color, texture) may exist between the photos presented and the final product, particularly for artisanal or made-to-measure creations.
2.3 Conclusion of contract: The presentation of products on the online shop does not constitute a legally binding offer, but a non-binding online catalog. The sales contract is only concluded upon receipt of the order confirmation sent by email by GECODART after validation of payment.

3. Prices and Payment Terms

3.1 Prices:

Prices are indicated according to the currency and residence of the CUSTOMER:

  • Private customers (B2C) Switzerland/Liechtenstein: Prices in Swiss Francs (CHF), Value Added Tax (VAT) included.
  • Professional customers (B2B) Switzerland/Liechtenstein: Prices displayed in Swiss Francs (CHF), excluding VAT.
  • Customers (all) European Economic Area: Prices displayed in EUROS (€), excluding Swiss VAT (export). The local VAT of the destination country must be paid by the customer upon importation (see article 6.3).

3.2 Price modification: GECODART reserves the right to modify its prices at any time. Products will be invoiced on the basis of the rates in force at the time of order validation.
3.3 Means of payment: Payment is made immediately upon ordering via the means proposed on the site (credit cards, electronic payment solutions, etc.). Cash payment is not accepted.
3.4 Retention of title: Delivered products remain the property of GECODART until full and final payment of the sales price, including ancillary costs.

4. Delivery and Transfer of Risks

4.1 Address: Delivery is made to the address indicated by the CUSTOMER when ordering. It is the CUSTOMER's responsibility to verify the accuracy of the information provided.
4.2 Shipping costs: Delivery costs are borne by the CUSTOMER, unless explicitly stated otherwise. They are indicated before the final validation of the order.
4.3 Deadlines: Delivery times are given for information purposes only and correspond to average processing and shipping times. GECODART cannot be held liable for consequences due to a shipping delay not of its making.
4.4 Force majeure: GECODART is released from its delivery obligations in the event of force majeure, including but not limited to: wars, riots, strikes, fires, natural disasters, or shortages of raw materials.

5. Customs Duties and Importation (Europe)

5.1 For any delivery outside of Switzerland and Liechtenstein, the CUSTOMER is considered the importer of the products.
5.2 Customs duties, local taxes, import duties, or state taxes may be payable. These duties and sums do not fall within the purview of GECODART. They shall be borne exclusively by the CUSTOMER and fall under their entire responsibility, both in terms of declarations and payments to the competent authorities of the country concerned.

 

6. Verification, Warranty and Complaints

6.1 Duty of inspection: Upon receipt, the CUSTOMER must immediately verify the condition of the packaging and the conformity of the products.
6.2 Transport-related damage: If the package is damaged, the CUSTOMER must imperatively express reservations to the carrier, take evidentiary photos, and inform GECODART customer service without delay.
6.3 Legal warranty: Unless otherwise provided, products benefit from the warranty for defects in accordance with the provisions of the Swiss Code of Obligations (Art. 197 et seq. CO), for a period of two years. The warranty does not cover normal wear and tear, nor damage resulting from misuse or improper maintenance.

7. Right of Withdrawal and Returns

7.1 Period: The CUSTOMER has a period of 14 calendar days from the receipt of the order to exercise their right of withdrawal.
7.2 Return conditions:

  • The CUSTOMER must first contact customer service to obtain a return slip or instructions.
  • Products must be returned in their original packaging, complete, unused, unwashed, and in perfect condition for resale.
  • The return shipment must be made no later than 7 days after the return request.

7.3 Exclusions: The right of return is excluded for:

  • Products made to the consumer's specifications or clearly personalized (made-to-measure).
  • Hygiene products unsealed by the consumer after delivery.
  • Sale or promotional products (unless stated otherwise).

7.4 Return costs: Return costs are exclusively borne by the CUSTOMER. If the return is due to an error by GECODART (defective product or not compliant with the order), return costs will be refunded.

8. Refund

8.1 In the event of a valid return, GECODART will proceed with the refund using the same means of payment as that used for the initial transaction or, with the CUSTOMER's agreement, in the form of a voucher.
8.2 The refund will be made after receipt and verification of the condition of the returned products, generally within 10 working days.
GECODART reserves the right to withhold processing fees if the product is not returned in its original condition.

9. Data Protection

9.1 GECODART undertakes to respect the confidentiality of the CUSTOMER's personal data.
9.2 Data processing is carried out in compliance with the new Federal Act on Data Protection (nFADP) in Switzerland and, where applicable, the General Data Protection Regulation (GDPR) for European customers.
9.3 Collected data is used for order processing and improving the customer experience.

10. Intellectual Property

10.1 Gecodart SA is the owner of the GECODART brand (registered) and operates the site www.gecodart.ch.
10.2 The entire content of the site (texts, images, graphics, logos, icons) is the exclusive property of GECODART or its partners and is protected by copyright. Any reproduction, distribution, or use without prior written authorization is strictly prohibited.

11. Limitation of Liability

11.1 GECODART cannot be held liable for direct or indirect damages that may result from access to or use of the site, including inaccessibility, data loss, deterioration, destruction, or viruses that may affect the user's computer equipment.
11.2 Although GECODART strives to keep the site up to date, errors (prices, descriptions) may occur. GECODART is only liable for direct and foreseeable damages resulting from gross negligence or intentional misconduct on its part.

12. Applicable Law and Place of Jurisdiction

The exclusive place of jurisdiction for any dispute relating to the interpretation or execution of these conditions is Geneva, Switzerland, subject to mandatory jurisdictions provided by law for consumers.
