
General Terms and Conditions (GTC)
Private and Professional Customers

Applicable language: In the event of discrepancy or conflict of interpretation, only the French version of these conditions shall prevail.
General provisions: In accordance with current Swiss legislation, the following information defines the General Terms and Conditions (GTC) of the website www.gecodart.ch for private and professional customers.
1. Scope and validity
1.1 These General Terms and Conditions (hereinafter "GTC") govern all contractual relations, rights and obligations between Gecodart SA (operating the online store gecodart.ch) (hereinafter "GECODART") and any natural or legal person ordering products or services on the gecodart.ch website. Persons acting in the context of their commercial or independent activity, as well as institutions, local authorities and other professionals, are hereinafter referred to as "PRO CUSTOMER". Natural persons acting in a private capacity are referred to as "PRIVATE CUSTOMER".
1.2 The GTC are an integral part of the contract concluded between GECODART and the CUSTOMER. By validating their order, the CUSTOMER acknowledges having read these GTC and accepts them without reservation.
1.3 Any purchase condition or contrary condition set by the CUSTOMER, in the absence of express and written acceptance by GECODART, will be unenforceable against the latter.
1.4 GECODART reserves the right to modify these GTC at any time. The applicable conditions are those in force on the site on the date the order is placed.
1.5 The PRIVATE CUSTOMER declares to be of legal age and have the capacity to exercise civil rights at the time of the order. The person validating the order for a PRO CUSTOMER declares to have the legal capacity and the necessary powers to validly bind the company they represent.
2. Registration and user account
2.1 The CUSTOMER has the possibility to create an account to facilitate their orders. The CUSTOMER undertakes to provide accurate information and to maintain the confidentiality of their identifiers. The PRO CUSTOMER undertakes to provide the exact name of the legal entity, and its IDE/VAT number if applicable.
2.2 GECODART reserves the right to suspend or delete a user account in case of non-compliance with these GTC or fraudulent use.
3. Offer, products and conclusion of the contract
3.1 Geographic availability:
Sale: The products available for immediate sale on the gecodart.ch store are intended for CUSTOMERS domiciled in Switzerland and Liechtenstein.
Manufacturing: Products requiring custom manufacturing are presented as examples and are subject to a specific request or a quote.
Rental: The products presented for rental are exclusively intended for CUSTOMERS domiciled in Geneva, Switzerland.
3.2 Characteristics: Products are presented as accurately as possible. However, slight variations (color, texture) may exist between the photos presented and the final product, especially for artisanal or custom-made creations.
3.3 Conclusion of the contract: The presentation of products on the online store does not constitute a legally binding offer, but a non-binding online catalog. The sales contract is only concluded upon receipt of the order confirmation sent by email by GECODART after validation of the payment, or upon signature of the quote.
4. Custom products and quotes
4.1 Requests for products requiring custom manufacturing are subject to a free, personalized quote.
4.2 The order is definitively validated (and becomes binding) after written acceptance of the quote by the CUSTOMER and receipt of the full payment or the deposit defined in the quote.
4.3 In accordance with article 8 of these GTC, custom-made creations do not benefit from any right of return or refund.
5. Prices, payments, promotional vouchers and retention of title
5.1 Prices: The prices displayed are exclusively in Swiss francs (CHF) and correspond to the rates in effect at the time of your order.
Private customers: Prices in Swiss Francs (CHF), value-added tax (VAT) included.
Professional customers: Prices displayed in Swiss Francs (CHF), excluding taxes (HT). The applicable VAT will be added upon invoicing.
5.2 Price modification: GECODART reserves the right to modify its prices at any time. Products will be invoiced based on the rates in effect at the time of order validation.
5.3 Payment methods: Payment is made immediately upon ordering via the methods offered on the site. For the PRO CUSTOMER, payment is made according to the conditions defined during the order or on the quote (immediate payment, deposit, or on invoice at 30 days net by agreement). The detailed modalities are defined in our Payment Terms , which are an integral part of these GTC. Cash payment is not accepted on the gecodart.ch store.
5.4 Gift vouchers and promotional codes: Gift vouchers and promotional codes are valid according to the conditions and duration indicated when issued. They are non-refundable and non-convertible into cash.
5.5 Retention of title: The delivered products remain the property of GECODART until full and final payment of the sale price, including ancillary costs.
6. Delivery and transfer of risk
6.1 Address: Delivery is made to the address provided by the CUSTOMER during the order. It is the CUSTOMER's responsibility to verify the accuracy of the information provided.
6.2 Shipping costs: Processing and delivery costs are the responsibility of the CUSTOMER, unless explicitly stated otherwise. Their modalities are defined in our Delivery Terms , which are an integral part of these GTC.
6.3 Deadlines: Delivery times are indicative and correspond to average processing and shipping times. GECODART cannot be held responsible for the consequences due to a shipping delay not of its own making. A delay does not give the right to any penalty or order cancellation.
6.4 Force majeure: GECODART is released from its delivery obligations in the event of force majeure, including but not limited to: wars, riots, strikes, fires, natural disasters, or raw material shortages.
6.5 Transfer of risk: The benefits and risks associated with the products pass to the CUSTOMER as soon as the shipment has been handed over to the company responsible for transport (ex works/warehouse).
7. Verification, warranty and complaints
7.1 Duty of verification and deadlines: Upon receipt, the CUSTOMER must immediately check the condition of the packaging and the conformity of the products. Visible defects or delivery errors must be reported in writing (with photos) to customer service within 5 days of receipt of the goods. After this period, the products are considered accepted.
7.2 Transport-related damages: If the package is damaged, the CUSTOMER must imperatively express reservations to the carrier, take compelling photos, and inform GECODART customer service without delay.
7.3 Legal warranty: Unless otherwise specified, products benefit from a warranty against manufacturing defects in accordance with the provisions of the Swiss Code of Obligations (art. 197 et seq. CO). The warranty period is 2 years from delivery. In the event of a proven defect, GECODART reserves the right to choose between repairing, replacing the product, or issuing a credit note. The warranty does not cover normal wear and tear, nor damage resulting from misuse.
8. Right of withdrawal and Returns (Specific conditions by customer type)
For PRIVATE CUSTOMERS (B2C):
8.1 Deadline: The PRIVATE CUSTOMER has a period of 14 calendar days from the date of the order to exercise their right of return. Detailed terms and conditions are set out in our Returns Policy , which forms an integral part of these GTS.
8.2 Return Conditions:
The PRIVATE CUSTOMER must first contact customer service for instructions.
Products must be returned in their original packaging, complete, unused, and in perfect resalable condition.
The return must be shipped no later than 7 calendar days after the return request has been validated.
8.3 Exclusions: The right of return is excluded for:
Products made to the consumer's specifications or clearly personalized (custom-made).
Products on sale or on promotion (unless otherwise stated).
8.4 Return costs: Return costs are the exclusive responsibility of the PRIVATE CUSTOMER. If the return is due to an error by GECODART, the return costs will be refunded.
For PROFESSIONAL CUSTOMERS (B2B):
8.5 Firm orders: In the context of B2B relationships, no right of withdrawal or return for convenience is granted. Any validated order is firm and definitive.
8.6 Exceptional returns: A return can only be accepted with the prior written consent of GECODART, and will be subject to a deduction for restocking fees.
8.7 Total exclusions: No returns possible for custom-made, personalized or sale products.
9. Refund (Private customers and exceptional B2B returns)
Detailed terms are defined in our Returns Policy .
9.1 In the event of a valid return, GECODART will proceed with the refund using the same means of payment as that used for the initial transaction or, with the CUSTOMER's agreement, in the form of a voucher.
9.2 The refund will be made after receipt and verification of the condition of the returned products, generally within 10 working days. GECODART reserves the right to withhold processing fees.
10. Data Protection (FADP)
10.1 GECODART undertakes to respect the confidentiality of the CUSTOMER's personal data (and company data). Detailed terms are defined in our Privacy Policy , which forms an integral part of these GTC.
10.2 Data processing is carried out in compliance with the Federal Act on Data Protection (FADP) in Switzerland for order processing and commercial relationship management.
10.3 The collected data is used for order processing and improving the customer experience. Use for marketing purposes (newsletter) requires the prior consent of the CUSTOMER (opt-in) or offers an opt-out option.
11. Reviews, Blog and Events
11.1 Reviews and comments: The CUSTOMER has the possibility to leave reviews on products or to comment on our blog articles. GECODART reserves the right to moderate, modify or delete any content of an insulting, defamatory nature or deemed inappropriate, without notice.
11.2 Events and Workshops: GECODART regularly publishes event dates. The conditions of registration, participation and possible cancellation are specific to each event and are detailed on the corresponding page.
12. Intellectual Property
12.1 Gecodart SA owns the GECODART brand (registered) and operates the www.gecodart.ch website.
12.2 All content on the site (texts, images, graphics, logos, icons) is the exclusive property of GECODART or its partners and is protected by copyright. Any reproduction or use without permission is strictly prohibited.
13. Limitation of Liability
13.1 General provisions: GECODART cannot be held liable for any direct or indirect damage that may result from accessing or using the site. Although GECODART strives to keep the site up to date, errors may occur. GECODART is only liable for direct damages resulting from gross negligence or willful misconduct.
13.2 Specificities for PRO CUSTOMERS (B2B): GECODART declines all responsibility for indirect or consequential damages (loss of turnover, operating loss, loss of profit) related to the purchase or use of the products. GECODART's liability towards the PRO CUSTOMER is strictly limited to the amount of the order in question.
14. Applicable Law and Jurisdiction
14.1 Applicable Law: These GTC are exclusively governed by Swiss law, excluding conflict of law rules.
14.2 Jurisdiction: The exclusive place of jurisdiction for any dispute arising from these GTC (B2C and B2B) is at GECODART's headquarters in Geneva, Switzerland, subject to mandatory forums provided by law for consumers.
15. Severability Clause (Partial Invalidity)
15.1 If any provision of these GTC is declared void or unenforceable, the validity of the other provisions shall not be affected (remains intact). The invalid provision shall be replaced by a valid provision or an economically equivalent clause coming as close as possible to it.
