1. Scope of application
1.1 These general terms and conditions of sale (hereinafter referred to as: GTC), govern the rights and obligations of the parties and apply to orders for products and/or services placed exclusively on the online store www.gecodart.ch (hereinafter referred to as: GECODART).
1.2 The GTC are an integral part of the contract concluded between GECODART and the client (hereinafter referred to as: CLIENT) at the time of purchase, and conditions that would go against them, such as those issued unilaterally by the CLIENT, are not applicable.
1.3 By placing an order, the CLIENT acknowledges that it has read and accepted these GTC without reservation. GECODART reserves the right to modify these GTC at any time. The date of the purchase is the reference for the version of the GTC in effect on the same date.

2. Intellectual property rights, image rights and copyrights
2.1 Gecodart SA is the owner and operator of the online store www.gecodart.ch, and owner of the GECODART® brand registered in the European Community EU.
2.2 The copyright of this online store belongs to GECODART or its respective owners, the downloading, copying, reproduction or transmission of content is strictly prohibited without the prior written permission of GECODART or its owners.
2.3 The fact of accessing our online store, brands, photos, logos, names, etc., does not lead to the acquisition of rights of use or intellectual property rights.

3. Data protection and confidentiality
3.1 All data collected during registration or browsing in the GECODART store will be processed and used for promotional and marketing purposes, however, the CLIENT will be informed in advance and can decide whether or not to accept the use of data collected via "cookies".
3.2 We comply with the legal provisions and ordinances relating to data protection law, in particular the General Data Protection Regulation (GDPR) and the Data Protection Act (DPA).

4. Products and services
4.1 All products presented in the GECODART.CH online store are intended for CLIENTS residing in Switzerland or Liechtenstein.
4.2 The products are valid while stocks last.

5. Prices and Payment
5.1 All prices are in Swiss francs, VAT not included, and can be modified at any time by GECODART, the prices in effect are the prices displayed at the time of purchase, if applicable, the advance recycling tax or other taxes will be included in the price displayed.
5.2 Shipping costs are at the CLIENT's expense and can be modified at any time by GECODART.
5.3 Payment in cash is not accepted.
5.4 The means of payment are presented at the time of paying for the goods, and are accepted as means of payment via e-Banking, bank transfers, credit cards, debit cards, TWINT and PayPal.

6. Availability and delivery
6.1 All orders are delivered to the delivery address indicated by the CLIENT when registering on the GECODART online store.
6.2 For any delivery of an order in a country other than Switzerland or Liechtenstein, the CLIENT must respect the import duties or taxes in effect in the country where the order is received and pay all of these duties or taxes.
6.3 The delivery times indicated in GECODART's online store are indicative and may vary.
6.4 GECODART is not responsible for delays or delivery failures resulting from circumstances beyond its control, such as: strikes, wars, natural disasters or others (non-exhaustive list).

7. Right of withdrawal and exchange
7.1 The CUSTOMER has the right to return the order within 14 calendar days after receipt, however, it must return the items in their original packaging, in good condition and without traces of use, accompanied by the purchase invoice and the return document, transmitted by the customer service.
7.2 The right of return is denied on some products, check the conditions of return mentioned in the product description on the product page at the time of purchase.

8. Complaints
8.1 The CUSTOMER shall check the received package for damage upon delivery of the goods and, if necessary, take photographs to prove it and inform the customer service immediately.
8.2 All complaints must be sent in writing in the form of an e-mail.

9. Applicable law and place of jurisdiction
9.1 Swiss law applies between GECODART and the CLIENT, and the exclusive place of jurisdiction for all disputes is Geneva.
